Terms and Conditions of Purchase

1. Purpose

These terms govern the purchase of products through the website www.mondelcava.com, owned by Establiments Domingo S.A. – Món del Cava. By placing an order, the user accepts these terms, which are permanently available on the website.

2. Users and scope of application

These terms apply to both individual consumers and companies or professionals. Withdrawal and warranty conditions may vary depending on the type of product. Customized or made-to-order products are managed exclusively by email or WhatsApp and are not processed through the online purchase system.

3. Purchase process

  1. Select the desired products and add them to the cart.
  2. Review your order and click “Checkout”.
  3. Register or log in with your user account.
  4. Enter the shipping address and select the shipping method.
  5. Choose a payment method and confirm the order.
  6. Receive an email confirmation of your order.

The contract is formalized upon confirmation and stored electronically. Món del Cava will include a printed invoice inside the package. If requested, a digital copy may be sent by email or WhatsApp. In the future, invoices will be available in the customer area.

4. Availability and substitutions

All products are subject to availability. If an item is out of stock after purchase, Món del Cava will promptly notify the customer and offer one of the following options:

  • Wait for restocking.
  • Replace with a similar product at no additional cost.
  • Refund the full amount of the unavailable product.

5. Prices and taxes

Displayed prices include VAT by default, unless the user has chosen to view prices excluding VAT in their account. Shipping costs are shown at the end of the checkout process whenever the shipping type allows.

For international shipments or large or heavy orders (+85 kg or unsuitable for standard parcel delivery), the system will notify the customer that shipping costs are being calculated and payment will be temporarily disabled. In such cases, the customer will receive a pro forma invoice by email with the total amount (products + shipping) and payment instructions.

Prices may change without prior notice, but those confirmed at checkout will always be honored.

6. Payment methods

Accepted payment methods:

  • Credit or debit card (secure SSL gateway).
  • Bizum.
  • PayPal.
  • Bank transfer (shipment dispatched after payment confirmation).
  • Google Pay (GPay).
  • Apple Pay.

7. Shipping and delivery times

Shipping company: GLS for parcels. Carriers for pallet shipments are selected by Món del Cava according to the best available rate.

Delivery times (parcels):

  • GLS Standard: Orders placed before 17:00 (Monday to Friday): shipped the same day, estimated delivery within 48–72 business hours (Monday to Friday). Orders placed after 17:00 will be shipped the next business day.
  • GLS Express 24 h: Orders placed before 17:00 (Monday to Friday): shipped the same day, delivered the next business day. Orders placed after 17:00 will be shipped the next business day.

For pallet shipments, the customer will receive a pro forma invoice by email with the total order amount, shipping cost, and payment instructions (as detailed in section 5).

In-store pickup: available after email confirmation, during store hours: Monday to Friday 8:00–13:30 and 15:00–19:00; Saturdays 9:00–13:00. Any schedule changes or holidays will be updated on Món del Cava’s Google business profile.

Delivery area: Spain and Europe. Other destinations available upon request. No minimum order and no free shipping threshold.

8. Right of withdrawal, returns, and exchanges

The customer has 14 calendar days from receipt of the order to withdraw from the contract or request an exchange, without providing a reason. To exercise this right, customers must email info@mondelcava.com stating the order number and the items to be returned or exchanged.

Products must be returned unused, in their original packaging, and with all accessories included.

Procedure:

  • Once the request is received, Món del Cava will inform the customer of the return process and cost.
  • After paying the cost, Món del Cava will arrange pickup via courier.
  • The courier will provide the return label at the time of pickup.
  • The customer may also ship the product using their own carrier.
  • After receiving and inspecting the items, the refund will be issued by bank transfer to the customer’s account.

Return and exchange shipping costs are borne by the customer, except in cases of error or defect attributable to Món del Cava.

Exclusions:

  • Customized or made-to-order products, or those not managed through the website.
  • Food-contact items (e.g., cork stoppers, seals, capsules, gaskets, etc.) cannot be returned once the original packaging has been opened, for hygiene and food safety reasons, in accordance with Article 103(e) of Spanish Royal Legislative Decree 1/2007.

9. Warranty and after-sales service

All products sold by Món del Cava are covered by the legal warranty of conformity under Spanish law (Law 7/2023 and Royal Legislative Decree 1/2007).

The customer has 14 calendar days from delivery to report any visible defects, damage to packaging, or missing items. After this period, the delivery is considered accepted, without prejudice to warranty rights. Notifications must be sent by email to info@mondelcava.com, indicating the order number and issue details.

Warranty coverage by product type:

  • Consumables and oenological materials (corks, capsules, gaskets, filters, containers, seals, etc.): 3 months warranty against manufacturing defects.
  • Mechanical equipment and machinery (pumps, destemmers, fillers, cappers, filters, etc.): 1 year warranty.
  • Electrical or electronic items (controllers, detectors, motors, control panels, scales, etc.): 3 years warranty.

The warranty covers only manufacturing or functional defects. It does not include wear and tear, misuse, improper installation, lack of maintenance, or poor storage.

To request warranty service, customers must contact Món del Cava at info@mondelcava.com or call +34 938 183 440. Món del Cava will handle the case directly with the manufacturer or distributor and inform the customer of the solution (repair, replacement, or refund as applicable).

10. Limitation of liability

Món del Cava is not liable for:

  • Interruptions or errors in website access.
  • Delivery delays caused by third parties or force majeure.
  • Minor differences between product images and the actual items due to manufacturer variations or display settings.

Use of the website implies acceptance of the conditions published in the Legal Notice.

12. Applicable law and jurisdiction

These terms are governed by Spanish law. In case of dispute:

  • For consumers, the courts of the customer’s residence shall have jurisdiction.
  • For companies or professionals, jurisdiction shall lie with the courts of Barcelona (Spain), unless otherwise required by law.
